Liu Xiu
Not to Be Asked
Before you write a rule that checks everyone, look for the door in it that was left open for your own people
Book of the Later Han, Annals of Emperor Guangwu (part 2); Biography of Liu Long
You want everyone checked, but a few names are ones nobody dares touch. How did Liu Xiu find the words 'not to be asked' on a clerk's tablet?
What actually happened?
Guangwu ordered every commandery to verify its farmland and households, and each sent men to report. On the tablet of a clerk from Chenliu he saw a line: Yingchuan and Hongnong may be questioned; Henan and Nanyang may not. Pressed, the clerk denied it, saying he picked it up in the street. A twelve-year-old prince, the future Emperor Ming, spoke from behind a curtain: Henan has many ministers, Nanyang many kinsmen, their holdings exceed the limits. The clerk then confessed. That line meant the emperor's own people.
The gap in a rule is often nearest to its author
The commanderies' practice was that others could be checked but the capital and the emperor's home region could not. The harder such a survey bears down, the more it falls only on distant people. The places to ask about were exactly the ones quietly marked off.
A firm audits every department's expenses, but nobody dares open the accounts of the owner and a few founders.
One line, followed to the end
He did not accept the tablet and move on. He asked where it came from, had the clerk examined again when he denied it, and sent an envoy to check on the ground. A small clerk wrote what he should not have, and the emperor neither ignored it nor stopped at scolding him.
A report has a column headed 'except for'. Before asking who wrote it, ask why the column is needed.
Do not write it up as impartiality
Zhang Ji, governor of Henan, and a dozen others died in prison for false survey figures; Liu Long, a veteran charged in the same case, was only reduced to commoner. This is not a ruler who spared nobody. It is one whose blows were weighted, though 'not to be asked' did reach the table.
If you spare a veteran, write the exception into the record where all can see it, and do not leave people to guess.
How do I use it today?
Where you are: you are about to bring in a rule that checks everyone, and you half know there are a few people no one dares touch.
Ask first: Does the list this rule runs on have names quietly marked 'not to be asked'? Am I checking the matter, or only the people far from me?
Where it goes wrong: telling it as a ruler who put his own kin to the knife. In the history he was driven on by a line of writing, and he still left a veteran a way out. This chapter is about finding the gap, not about praising how thoroughly it was closed.
Lines to keep
Henan, the imperial city, has many ministers; Nanyang, his home, many kin.
Then an envoy was sent to verify, and the whole fraud was known.
Zhang Ji and a dozen governors died in prison for false survey returns.
